Supreme Scratch & Score Game
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. THIS SWEEPSTAKES IS INTENDED FOR VIEWING IN THE UNITED STATES ONLY & SHALL ONLY BE CONSTRUED & EVALUATED ACCORDING TO UNITED STATES LAW. YOU ARE NOT AUTHORIZED TO PARTICIPATE IN THIS SWEEPSTAKES IF YOU ARE NOT A LEGAL RESIDENT OF CT, NJ & NY.
Eligibility: Dunkin' Donuts Supreme Scratch & Score Game (hereafter, "Game"), is only open to legal residents of Connecticut, New Jersey and New York 18 years of age or older prior to 8/28/06. Employees of Dunkin' Brands, Inc. & DB AdFund Administrator LLC ("Sponsors"), DD Master Finance LLC, Dunkin' Donuts Advertising & Sales Promotion Fund, and any of their respective parent companies, affiliates, franchisees, licensees, officers, directors, employees, vendors, subsidiaries, distributors, suppliers, subsidiaries, retailers, advertising and promotional agencies (collectively, the "Released Parties"), and any other entity directly involved with this Game, including immediate family members (mother, father, brothers, sisters, sons, daughters & spouse, regardless of where they reside) and household members of any such individual, whether or not related, are not eligible to participate. All federal, state and local laws and regulations apply.

How to Play the Game: Game begins on 8/28/06, and ends on 10/08/06 or while supplies last. There are two ways to enter this Game.
(1.) Receive an Instant-Win Game piece with the purchase of any breakfast combo meal at a participating Dunkin' Donuts shop in CT, NJ or NY. A total of 3,500,000 game pieces will be distributed to the participating Dunkin' Donuts shops
OR (2.) Obtain a free Instant Win Game Piece without purchase, while supplies last, by printing on a 3"x 5" card or piece of paper, your full name, complete mailing address, telephone number & date of birth along with a self-addressed stamped envelope (VT residents may omit return stamp) to: ASC/Dunkin' Donuts Game Card Request, 300 State Street, Suite 402, Rochester, NY 14614.
Limit one (1) request per postmarked outer envelope per day. Requests must be postmarked by 10/08/06 and received by 10/15/06. Typed, computer generated, or otherwise mechanically reproduced outer envelopes/requests are NOT allowed and will not be accepted. A proof of mailing/delivery is not proof of receipt or of winning. All entries become the property of Sponsors and will not be returned. Your receipt of an Instant-Win game piece constitutes your consent to participate in this Game. Released Parties are not responsible for lost, incomplete, illegible, incorrect, delayed, garbled, undelivered, misdirected, stolen, postage-due or late entries; theft, destruction or unauthorized access to, or alteration of, entries; typographical, printing or other errors or omissions in these Official Rules, in any -Game related advertisements or other materials (including game pieces), or other problems or errors of any kind whether mechanical, human, electronic, typographical, printing or otherwise relating to or in connection with the Game, including, without limitation, errors or problems which may occur in connection with the administration or the execution of the Game, in the processing of entries, in the selection or announcement of winners or in the awarding of prizes. Sponsors reserve the right, in their sole discretion, to void any and all entries of an entrant who Sponsors believe has attempted to tamper with, influence or impair the administration, security, fairness or proper play of the Game.

Winner of Grand Prize will not be able to choose which Cruiser they receive, this will be the sole determination of the Sponsor prizes include only those features specified herein. No other features or upgrades will be allowed. Winner must be a licensed driver and will be required to provide proof of insurance at the time of delivery. Winner is responsible for title, license, registration, dealer preparation costs, auto insurance, taxes and other fees associated with prize. Winner must take delivery of prize from the automobile dealership or other third party designated by Sponsors. Each automobile will be delivered to winner wrapped with artwork depicting either the Giants or Jets logos. Winner, at its option, will be responsible for the cost of removing such artwork.
Prize Claims:
Instant Prize Claim: To claim all instant prizes, fill in your name, address, age and daytime phone number on the backside of the winning game card,
photocopy front and back of card for your records and send the
ORIGINAL complete game card (no copies or mechanical reproductions accepted) by
Registered Mail, return receipt requested, to: ASC/Dunkin' Donuts, 300 State St. Suite 402, Rochester, NY 14614. (Minors must also include name and address of parent/legal guardian). All prize claims must be postmarked by 10/08/06 and received by 10/22/06. Following verification of winning game pieces, winners will be notified by mail. All prize claims are subject to verification by an independent judging organization whose decisions are final.
Food Prizes: Present winning game card containing free product offers to server at
your next visit to any participating Dunkin' Donuts shops in CT, NJ or NY. All claims must be received by 12/31/06.
Conditions and Limitations: By participating in this Sweepstakes, entrant agrees to these rules and the decisions of the judges, which are final and legally binding in all matters relating to this promotion. All game pieces are subject to verification and are void if (a) not obtained in accordance with these Official Rules and through legitimate channels; (b) any submitted winning game card that is counterfeit, altered, defective, illegible, reproduced, tampered with, incomplete, forged, illegible, mutilated, altered, duplicated, or obtained through unauthorized distribution channels, or (c) contain printing, typographical, mechanical, seeding or other errors will be null and void. Entrants assume all risk of loss, damage, destruction, delay or misdirection of sweepstakes materials/mail submitted to Sponsors. All prize winners (Grand Prize and Prize Winners 1 through 8, respectively) will be required to execute and return (within 14 days of written notification) an Affidavit of Eligibility and Liability and (where legal) Publicity Release. Failure to comply with the 14-day time period may result in disqualification and an alternate winner to be selected. If prize or prize notification is returned as undeliverable, prize will be forfeited and may be awarded to an alternate winner. If by reason of a printing or other error, more prizes are claimed than the number set forth in these rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded. The Sponsors reserve the right to substitute a prize of equal or greater value, at its sole discretion. No substitution (except by Sponsors), assignment or transfer of prize is permitted by winner. No cash equivalent is offered. In the event of a printing or production-related error, neither Sponsors, nor their advertising/promotion agencies nor their respective agents or suppliers shall have any liability. Liability for any irregular, damaged, or missing game pieces is limited to a free replacement, while supplies last. In no event shall more prizes be awarded than the number stated in the "Prizes" section above. All federal, state and local taxes are the sole responsibility of winner. Acceptance of a prize constitutes permission to the Sponsors and their agencies to use winners' names, photograph, and/or likeness, voice/ city/state of residence, for advertising, publicity, trade or any other purposes in any media or format now or hereafter known worldwide in perpetuity, without further compensation, permission or notification except where prohibited by law. By entering, the entrant agrees to hold harmless and indemnify Released Parties and their subsidiaries, affiliates, directors, officers, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of entrant's participation in this promotion, and/or the receipt or use of the prizes awarded herein. By participating in this promotion, entrants agree to be bound by these Official Rules and agree that any dispute with regard to the conduct of this Game, rule interpretation or award of prize shall be submitted in writing to the Independent Sweepstakes Administrator listed below, whose decision shall be binding and final. Noncompliance with any of the foregoing may result in disqualification. Released Parties and their designees and assigns and all of their respective officers, directors, employees, representatives and agents shall have no liability and will be held harmless by entrant for any liability, loss, injury or damage to themselves or any other person or entity, including personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any of the prizes or participation in this Game. Sponsors reserve the right, in their sole discretion, to disqualify any entry and to modify, terminate or suspend the Game should non-authorized human intervention, action of entrants, or any action or event beyond the reasonable control of Sponsors corrupt or impair the administration, security, fairness or proper play of the Game.
Disputes: By entering the Sweepstakes, entrants agree that (1) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or of the rights and obligations of the entrants and Sponsors or the Released Parties in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the Commonwealth of Massachusetts. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts located in the Commonwealth of Massachusetts and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Official Rules. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as of the invalid or illegal provision were not contained herein.
