How does one get permission for others to off road on their land?

Hello.


and hi.



so let's say, hypothetically, you had some land.


and let's say, hypothetically, that it was in virginia.


and let's say it was (this is all hypothetical) zoned for agricultural use.


and, continuing with the hypothetical theme, let's say it was, oh, awesome for off roading.


and what if, hypothetically, you wanted to turn it into an off road oasis/park/allow FJ peeps on said hypothetical land?

what would one hypothetically need? a waiver for them to sign so when/if they flip it's not your fault? is there some sort of zoning category for off roading?

the only example that comes to mind is paintball fields. What are those people? How does one start that? it can't just be about randomly inviting people in the middle of the woods to get shot (i know, i know, SUCH a Stalinism/WWII analogy waiting in there - let's let this one pass).

so there it is. help please.

dont know much, but i know that in dallas/ ft worth texas, there are few off road parks, and the biggest issue that ive been told about, is insurance! other then that, and im sure loads of liability issues, i wish i could be of more assistance

Insurance, EPA and local zoning laws would be a start.

That posted before I wanted it to. The Coon Creek link in my sig is local here in TN. The POC listed is Jeff Green, he is the owner. If you gave him a shout I'm sure he would be able to point you in the right direction. I know alot of parks here in TN are being closed down by the EPA.

Generally, if you go to an off-road park, you sign a waiver when you pay the fee. In addition, if there are any kids under 18, they need to have a separate waiver signed by a parent or legal guardian.

I've crossed and hunted on a ranch in north AZ in return for letting me do this I repaired some fence and gave some of the deer to him.
I was asked back so I think that's a good sign.

I stayed mostly on exciting roads and never abused his land.

I own rural land in two different states (neither of which is Virginia FWIW). In Texas, you can do pretty much whatever you damn well please with your own rural land. Zoning is mostly a city limits kind of thing here, so you don't need any special permit or permission for agricultural, commercial, residential, or any other kind of use.

At my other place in New Mexico, the county is trying to pass county-wide zoning restrictions on some aspects of new home building, but otherwise again you can use your own land in any way you see fit. There is an ad hoc "neighborhood" association that is trying to shut down a commercial gravel quarry on BLM land in the same mountain range where I am, but they are not having much success because they have no legal basis that I can discern.

As long as you're not in any city limits, you are probably good to go but I would call your county government office and ask just to make sure.

If you DON'T charge a fee...there's nothing needed.....If you DO charge a fee....you need everything...permits/insurance/licence and everything else any other business needs.....
