Exclamation Omnibus Land Act of 2009

I know you are concerned about closures of our public lands. The Omnibus Land Act of 2008 is a massive land grab bill that will lock up millions of additional acres of public land, close thousands of miles of recreation trails, harm already struggling rural economies, further reduce renewable resource harvesting, be detrimental to forest health by eliminating all forest management, restrict property rights and hamstring energy exploration in the United States.

Dear BRC Action Alert Subscriber,

Senator Reid is planning to push through a massive omnibus lands bill during the Lame Duck Session of Congress. For those of you who are new to BRC's Action Alert list, the omnibus land bill is "catch all" legislation consisting of more then 150 separate pieces of legislation!

According to an article in Public Lands News (Resources Publishing Co.), the Senate Energy Committee recently added bills to the package that would designate millions of acres of Wilderness in eight states, designate at least three wild and scenic rivers, designate four national trails, and authorize dozens of land exchanges and land conveyances.

And the news just keeps getting worse. Although unconfirmed, Washington D.C. insiders say Idaho Congressman Mike Simpson is trying to attach the Central Idaho Development and Recreation Act (CEIDRA) to the omnibus package.

I suppose that could have been predicted. See, the omnibus package is a not-so-clever way our Congressional representatives can pass bills, like Simpson's CEIDRA, that can not pass on their own merits. CEIDRA would close hundreds of thousands of acres of premium high country snowmobiling and over 80 miles of mountain bike trails. Idaho's recreational community has successfully fought to oppose the bill in its current form.

But the news is not all bad, and there is good reason to believe action taken now could be effective. Some legislators, such as Idaho's Larry Craig and Utah's Rob Bishop are trying to shed some light on some of these bills, just to see exactly why they can't stand on their own merits.

Bishop initiated an investigation of the bill that would formally establish the National Landscape Conservation System (NLCS) and guess what he found? Information suggesting that Bureau of Land Management employees may have violated the 1939 Hatch Act, which bars federal employees from lobbying Congress.

As a result of Bishop's inquiry, the Interior Department's Inspector General is investigating links between BLM and environmental lobbyists. Environmental lobbyists and BLM officials appeared to have inappropriate discussed the passage of the NLCS legislation and may have worked together on draft policy memoranda.

In addition, Oklahoma Senator Tom Coburn continues his opposition to the pork-barrel spending included in the omnibus package. The $4 billion omnibus package funds such things as birthday celebrations for cities, tropical botanical gardens, and a study determining whether Alexander Hamilton's boyhood estate is suitable to become a new National Park.

BRC is asking all our members and supporters to contact their Senators by phone and ask them block passage of the Omnibus Public Land Management Act of 2008. Senator Reid plans a vote for NEXT WEEK, so please make your call today.

He said he remembered the alert, so I asked him if he'd called his Senator. He said he hadn't. He said he just "figured" BRC was on the case. Senator Reid recently stated that the passage of the Omnibus Public Land Management Act of 2008 will be a high priority for the Lame Duck Session of Congress beginning November 17, 2008.

The omnibus package includes bills that could not pass on their own, like the "Owyhee Initiative." It also includes dangerous legislation such as the National Landscape Conservation System Act, which would formally establish a Clinton/Gore administrative fiat established by Bruce Babbitt.

WHAT YOU NEED TO DO:
Please call your Senator and ask them to vote NO on the Omnibus Public Land Management Act of 2008.

2. Under the column "President & Congress," click on the name of the "Senator or Representative" you wish to call.

3. Click on the "Contact" tab, this will show all the contact information for that person, including phone numbers for their state and federal offices.

I strongly oppose combining many of these so-called "land bills" into one "Omnibus" package. Doing so eliminates careful review and allows special interest groups with large powerful lobbies in Washington DC to outweigh the voice of individual citizens, such as myself, who regularly visit and enjoy our public lands.

I am also very concerned about how specific bills contained within the Omnibus package will eventually eliminate public access to public lands. Specifically, the National Landscape Conservation System (S. 1139 & H.R. 2016), the Prehistoric Trackways National Monument (S. 275) and the Owyhee Public Land Management Act of 2008 (S. 2833)

In a last minute move the newly elected Congress may vote as early as Tomorrow-Sunday without adequate public input on Omnibus Land Bill S22. Jan. 11 (Bloomberg) -- The U.S. Senate, in its first order of business this year, advanced a $10 billion conservation plan that would set aside more than 2 million acres of natural wilderness and protect 1,000 miles of scenic rivers.

The Omnibus Public Lands Management Act, the first piece of legislation considered by the new Senate, combines about 160 individual environmental bills in nearly 1,300 pages.

The measure “is possibly the most significant conservation legislation passed by the Senate in the past decade,” Senator Jeff Bingaman, chairman of the Energy and Natural Resources Committee and the bill’s chief sponsor, said on the Senate floor today. Two days ago, Bingaman, a New Mexico Democrat, said the measure was “developed on a bipartisan basis” and approved by his committee in the last Senate.

The 66-12 vote overcame an effort by Senator Tom Coburn, an Oklahoma Republican, to kill the legislation. The Senate will debate and vote on the bill’s passage this week.

Environmentalists led by the National Landscape Conservation System have rallied around the legislation. The group is an alliance of 80 environmental groups including hunters, hikers, archaeologists and ranchers. One of the legislation’s central provisions would add 2 million acres in eight states to the National Wilderness Preservation System, which currently has 107 million acres in 44 states, according to the Congressional Research Service.

The package has drawn fire from several lawmakers and interest groups who say the conservation measures would restrict access to gas and coal reserves and deepen U.S. dependence on foreign energy. The U.S. Chamber of Commerce and fiscal watchdog Club for Growth are among those opposing the legislation.

Oil and Natural Gas

Coburn, citing data from the Bureau of Land Management, predicted that the legislation would take about 8.8 trillion cubic feet of natural gas and 300 million barrels of oil out of production in Wyoming alone.

“The energy resources walled off by this bill would nearly match the annual production levels of our two largest natural gas production states--Alaska and Texas,” Coburn said in a written statement.

The bill also contains billions of dollars for special projects known as earmarks, including $1 billion for a California water project to protect salmon migration and $3.5 million for a commission to commemorate the 450th anniversary of the founding of St. Augustine, Florida.

Gasoline prices reached a record in July last year before declining during the following months. The average per-gallon price peaked at $4.11, according to AAA, the largest U.S. motorist group. U.S. auto sales in December plunged 36 percent, leaving the industry’s 2008 sales volume at a 16-year low. Sales of the top model of trucks made by Ford Motor Co., based in Dearborn, Michigan, and Detroit-based GM, fell 25 percent last year.

Beaver Basin Wilderness- Michigan
This legislation would designate over 11,000 acres of Wilderness within the Pictured Rocks

National Landscape Conservation System Act
This simple legislation would codify the National Landscape Conservation System,

Wyoming Range Legacy Act
This legislation would withdraw from oil and gas leasing over 1.2 million acres of
breathtaking, wild landscapes in the Wyoming Range of western Wyoming’s Bridger-
Teton National Forest. The iconic Wyoming Range features world-class hunting,
strongholds for cutthroat trout, and half of Wyoming’s moose populations, all of which

Washington County Growth and Conservation Act – Utah
This legislation would designate over 235,000 acres of wilderness in and around Zion
National Park in southern Utah. The legislation would also establish two new national
conservation areas and would create several new wild and scenic rivers. Utah’s scenic
red rock country is a land of stark beauty renowned worldwide. This bill would preserve
important elements of this iconic landscape. The 2008 version of the legislation can be
found through: THOMAS (Library of Congress).

Izembek and Alaska Peninsula Refuge and Wilderness Enhancement Act
This legislation would allow for an unnecessary and ecologically harmful road to be built
through fragile, internationally important wetlands Wilderness habitat in the Izembek
National Wildlife Refuge. The refuge is of critical importance to hundreds of thousands
of the world’s migratory birds. This provision has no place in a lands bill focused on
protecting America’s natural resources. For more information, see:

Of specific concern to socal folks are the areas around Joshua Tree and Zion.
