Well here is the ultimate update. I have arbitration set for January 24th at 11:00am at the dealership. The truck is currently at the dealership. I get a letter on 01/10/08 from the dealership saying that I need to remove my vehicle from the premises and that I will be charged 35$ a day storage after that. They sent this on 01/09/08. I call and explain that the only reason it is even still there is because the Arbitrator wants to inspect the vehicle. The response I get to this is that the owner of the dealership and Toyota's legal department need it removed in 48 hours from right now. They expect me to arrange for a tow truck to come get the vehicle and then return it in less than 2 weeks for the arbitration and that this is my responsibility not theirs. I am at a loss for words. I have no idea how I am going to get this to happen or even why i should considering the situation. Any advice is very very welcome.

Sorry about your problems...If you were close to me, I'd come with my 20' flat Trailer and haul it for you, but driving to WI and back will cost more in fuel then a tow service. Maybe someone closer has a trailer and can help you.

I am by no means a legal assistant, though I am a stuborn SOG.
You can risk the issue, if the dealership is responsible for fising the FJ after the arbitration, you can have them pay for the tow charges or they can keep the FJ on the lot, which is free to them. You should consider how much it would cost to keep the FJ there for the time you wait for arbitration and the cost for towing twice, you may end up paying out of pocket.
This situation totally inhales hard, I wish you the best of luck.

I called the NCDS (the third party doing the arbitration) and they suggested i call the toyota 1800 number to see if my case manager with toyota can do anything. Called him. He is unavailable but can call me back within 48 hours and toyota considers that acceptable. NCDS tells me that if i do have to tow, they can have an independent inspector view it elsewhere rather than having to tow twice. That is good at least, but the dealership and toyota have given me so many additional hassles and roadblocks to getting this handled that I am NEVER going to buy a toyota again. I will keep the FJ no matter what and get it going again.(paid too much not too.) But i am severely disheartened. This has taken all of the joy out of this truck and this hobby. I am sure i will still go wheeling, but it wont be for a while...at least until i can get the bad taste of this experience out of my mouth. Still waiting on a call back form customer service and havent set up a tow.

Thanks Al for the previous offer, but that would have been way too much in gas. Father in law was able to get his brothers trailer for his skid steers and load the FJ up last night. Amazingly no-one said a thing that we were just trailering an FJ off of the lot! Storing it on the trailer at his parents farm about 10 miles from the dealership. Will call NCDS on monday and see what they suggest...either independent inspection on the farm or trailer to dealer for the hearing. Either way, I am still pissed that this was such an ordeal and that they needed it moved NOW when it has been there since Dec. 4th. We will see what comes of the hearing. I have a feeling I will get hosed considering the way everything else has gone so far. If that happens we will be trailering it down to CTR automotive in Janesville.
