Re: Is Tossing Out a Cigarette Butt Littering?

So to those of you who say banana and other foods are ok to leave out. What about something like a twinkie , is that biodegradable ?

California Vehicle Code section 23111. No person in any vehicle and no pedestrian shall throw or discharge from or upon any road or highway or adjoining area, public or private, any lighted or nonlighted cigarette, cigar, match, or any flaming or glowing substance. This section shall be known as the Paul Buzzo Act. Amended Ch. 1548, stats 1970, effective november 23, 1970.

There ya have it. You can be cited for throwing a butt on the street. Guess what? I know a LOT of officers that cite for that all the time. The officers have yet to lose in court.

Re: Is Tossing Out a Cigarette Butt Littering?

California Penal Code section 374. Definitions; littering; waste matter

(a) Littering means the willful or negligent throwing, dropping, placing, depositing, or sewwping, or causing any such acts, of any waste matter on land or water in other than appropriate storage containers or areas designated for such purposes.

(b) Waste matter means discarded, used, or leftover substance including, but not limited to, a lighted or nonlighted cigarette, cigar, match, or any flaming or glowing material, or any garbage, trash, refuse, paper, container, pachaging or construction material, carcass of a dead animal, any nauseous or offensive matter of any kind, or any object likely to injure any person or create a traffic hazard.

With the bolded area, I'd say anything you throw in the street/highway is illegal in California. That includes banana peels, apple cores, etc. Water doesn't count.

And just so we're clear....I'm not talking about throwing out parts of lunch on the street or highway.....I'm talking about on the trail. I'll throw it off in the bushes or bury it. Either way, something it gonna eat it be it bread crust, apple cores or whatever.

I don't like it either way. However, I hate when im driving and I see ambers bounce all over the road in front of me. At least smash the thing before ya throw it out.

They love to go after motorcyclists, too. No ashtray on board, so if you are smoking, you are likely to soon be littering...

I had a friend who was pulled over for smoking on his motorcycle- when the officer asked him where was he going to put his cigarette butt when he was done, he promptly unscrewed his mirror, and stuck the butt in the threaded opening. He avoided the ticket for littering;

...but he got written up for no mirror.....

I don't know Arizona law, so I can't say that's littering in your state. I can tell you that I think it's bad form to do so. And I can also tell you in Calif, that would be considered littering.

Re: Is Tossing Out a Cigarette Butt Littering?

Littering. Ok, I am a smoker but I never smoke inside the FJ or inside the house my smoke butts are always properly disposed. Especially on the trail I carry a half full water bottle that is where it goes I even pick butts of the ground trails don't exactly have Janitors cleaning up after people. I see the Japanesse tourist walk around with the collapsible ashtray in their pocket they even put their ashes in there now that is civilized.
