You can try, but the PC for the stop is good.
If you don't want to take responsibilty for your actions, a high priced lawyer might be able to get you out of it, as thats why they cost an ARB bumper. Tint meter is done to determine how dark the tint and to confirm the officers observation that there is a tint on the window.
I'll let the lady who's child was killed playing in the street by a DUI that I have better things to do than process the drunk driver. I'll let him just go home next time instead of jail.....
Stay Safe!
lol somebody doesn't read the forums too often I take it :P
Dave when you started this thread I thought you were nuts. But after watching from afar I'm impressed with your patience and your skill at answering questions and addressing comments that aren't necessarily kind to our occupation. In case somone hasn't said thanks lately, THANKS! Tom and Elaine
Ok I have a question: I went out to the bars last night and I drove home. I didn't realize I had my headlights off, and they were only running on daytime. So I got pulled over for malfunctioning rear taillights. The cop didn't even realize my headlights were technically off. Anyway, he then smelled alcohol on my breath and did a couple of field sobriety tests and I ended up with a DUI.
So my question is, do you think I can take this to trial and fight this on the grounds that he did not have probable cause to stop me in the first place, since his PC was for malfunctioning tails, when in fact, they were just off and are working just fine. I hope I can dismiss this DUI and just get a fix it ticket for my tinted front windows (he got me for them too. I don't understand, my state says no tint whatsoever, and he had a tint meter. Why a meter if I'm not supposed to have them. Don't they have anything better to do, like catch rapists and murderers in the act instead of giving a ticket to a law abiding citizen like me?)
'sniff 'sniff... I smell BS... Did you really get popped for DUI or are you flame-baiting? I'm no expert either, but it seems pretty obvious that you were pulled over for a legit reason - no tail lights - alcohol was smelled - and you tested over the limit. If this is what really happened, it sounds like a police officer did a good job.

Ya I laughed at that thread of him trying to get out of the DUI.... I believe he got flamed pretty bad.
