I hate lawyers....but this deal needs one...or two...or three....
the truck is sold as a wheeler
It's got a 3yr/36k drive train from the factory
They have to cover it unless THEY CAN PROVE IN COURT you abused it beyond what it was sold to do....
Pay the bill with your credit card...go home...call credit card company and start a case...Toyota doesn't get paid untill THEY prove there case in court....
After the warranty....call All-pro and gear it right!!!! It's cheaper and WAY better

I should never have to think to hire a lawyer just to get my truck fix.
The facts are all there black on white! They're wrong...We're right!!!
But by the time I hire a lawyer, I will have spend more money than the parts needed to fix my truck cost. I'm not saying I won't but I would like to see Gary's outcome first, it's more important to get my truck going and I don't trust Toyota anymore anyway. My truck will be on the road by Monday and at Grey Rock AL. by the following weekend.
If I go the lawyer route now, I will have to pay a retainer as well as the repair...that would amount to about $3000 to $4000 but the parts to fix it only cost about $950(discounted).
But again Thank you and I hope to one day meet you in person...

In the appraisal business we have what is call "drive by" appraisals, where it seems the appraiser slowed to 25 mph to "inspect" a property. In Atlanta it seems the dealerships are doing "drive by" inspections, basing their "inspections" on looking at the tires and bumper from behind their desk and through the window, then telling you that a mechanical part in a sealed component is not covered because you "abused" the vehicle.
As a first time Toyota owner, this is bitter sweet. I still think the FJ Cruiser is a great vehicle and I love driving it, however this experience proves that Toyota is just like any other car company and their "quality" is not as good as the hype.

I use to be the biggest Toyota fan but now I feel like taking their logo and replacing it with "NO WARRANTY INCLUDED"

Mine(rear diff) broke twice...fixed twice...no charge....By Toyota...so I don't have a personal gripe with Toyota....
Although...
I've been burned by dealers... And I've hired the lawyers AFTER getting it fixed AND paying for it out of pocket...And I won in court and THEY payed all lawyer fees...although this was with AM General over an H-1 engine...It cost me NOTHING!!!

It is a known problem and recognized by Toyota or at least they admitted it to us at training for the Trail Teams.
The only Toyota employees at the training were the Marketing people. The head one doesn't know a diff from a slider (which they almost didn't get until 4 phone conversations later explaining what a slider does). Maybe they had conversations amongst themselves about breaks and causes, but I do not believe those actual words were said by a Toyota engineer/problem-solver type

I will get more details about who said what to whom, but the impression that Toyota Motor Sales, Inc knows of the issue still seems pertinent.
I hope the line in your sig is sarcastic, because I don't see how cereal compares to an offroad truck. There is not one picture of the FJC driving on a street in the three volumes of brochures I have. If they market it as an off road vehicle then it better perform as one. Most of the breakages we've heard described have been on much less severe terrain than pictured on the FJ Bulletin site.

My truck will be fixed today, and I will have the broken gear. I will send it to get tested, please PM me an address I can mail it to. I'm at the $4000 dollar mark counting legal fees and out of pocket repairs, and I'm unemployed and in school right now. Thank god for Mastercard. I also sold my VW Golf to help out some too, but now I have to drive the FJ every day... On the bright side, SEE YOU GUYS AT GRAY ROCK!!!!!!!!!!
