After reading this and the body panel rips i wrote Toyota and received this response:

We are not aware of any current concerns regarding the differential or the front body panels and after checking our database have found no Special Service Campaigns (SSC) / recalls or Technical Service Bulletins (TSB) that would address these issues.
Since we are not structured to offer on-line technical evaluations, repair, or diagnostic information, we recommend you contact the Customer Relations Manager at your local Toyota dealership to further evaluate your FJ Cruiser.
Toyota dealership technicians are specialized in the diagnosis and repair of Toyota vehicles. They are provided with extensive training and have access to state-of-the-art equipment to help in the accurate diagnosis of your vehicle. Also, if necessary, we provide additional support to assist Toyota dealership technicians in resolving unusual vehicle concerns.

I got the FJ back and everything seems to be ok... It should be since I had to pay $2042.59. Hopefully I'll get it back from my lawsuit. Thanks for the break in tips MissFJ, I went to SC this weekend so I'll be over 500 miles by the time I get to Gray Rock. I just wanted to let everyone know I'm back on the road and I'll see you GA Cruisers at the meeting Tuesday.

Toyota Mall Of Georgia denied the repair on my busted diff under warranty for miss use of my vehicle, the main manager I tried to talk to was rude and was not interested in hearing anything I had to say. Great customer service! way to go TOYOTA!!
And Milkyxj(Gary), they also ask me to tell you to get your truck off the lot or they would start charging you storage...
This is how I feel right now... ...I'm the lower banana

I will have the truck towed back to my house, the parts are coming in Saturday and if I don't get any result with Toyota corp i will fix it myself and then take action...
Gary, don't let them fix your truck....they don't deserve the business!
They had no business telling me to talk to you about removing your truck from their lot, that was very unprofessional in my opinion.

The facts are all there black on white! They're wrong...We're right!!!
But by the time I hire a lawyer, I will have spend more money than the parts needed to fix my truck cost. I'm not saying I won't but I would like to see Gary's outcome first, it's more important to get my truck going and I don't trust Toyota anymore anyway. My truck will be on the road by Monday and at Grey Rock AL. by the following weekend.
If I go the lawyer route now, I will have to pay a retainer as well as the repair...that would amount to about $3000 to $4000 but the parts to fix it only cost about $950(discounted).
But again Thank you and I hope to one day meet you in person...

I use to be the biggest Toyota fan but now I feel like taking their logo and replacing it with "NO WARRANTY INCLUDED"
But I still love my truck!

Update on my situation with Toyota Mall Of Georgia and Toyota Corp. about my busted rear diff.
I didn't say anything about my truck being worked on by another dealership before since Toyota Corp made it very clear to me that no dealership were allowed to work on it and that their decision about not covering the rear diff under warranty was final.
They also told me that arbitration would be my next available option to resolve the issues and it could take up to 40 days.
So the lesson to be learned here is that Toyota Corp. will back up the dealership's decision 100% right or wrong...
Not much of an option if you ask me...
The latest is, I picked up my truck from another dealership where they fixed it under warranty!
So thanks to a good friend of mine who shall remain nameless for now that contacted his dealership and explained my situation and then told me to take my truck there to be examine by the service dept. where they found that the rear diff. had in fact failed due to a defective part and not abuse by me.
The best scenario is DON"T GO WHEELING BY YOURSELF!
And by the way...if you own an early FJC, the rear diff. may break even if you don't wheel hard.(sorry for the bad news...)
I posted this way before mine broke...It may or may not happen to you but if it does pick your dealership wisely!
