I purchased my FJ Cruiser from Mossy in San Diego with custom wheels that they installed as a $3995 upgrade. The wheels have an offset that causes rubbing on the frame on the front driver's side (just driver's side).
I have asked them for a solution. The only one they have is to install factory wheels and have me eat the $3995. I asked about a body lift and trimming the frame. They are not options ... Mossy does not do lifts and will not trim the frame.
I'm supposed to eat the $3995 and settle for factory wheels and tires?

You may be able to slove this thru a proper alignment. The second alignment I had at 15,000 mi resulted in a tire rub on the right hand side only. I returned it and had it returned to the specs of my first alignment, and everything is OK. The fact that you said it's only on one side is what makes me suspect.

I have never done this myself, but I have a coworker who got a problem taken care of at BMW when he filed a complaint with the California Department of Consumer Affairs (CDCA). It may be that when the CDCA approaches the dealership, they may not like to have the problem on the record and take care of the issue. Here's a link to CDCA's website:
But first, I think you can try this easy solution: If you are married or have a girlfriend, take the woman with you, she may be more convincing; my wife for example always seems to get her way with service/sales guys just by showing up and saying a few words, like "this is unacceptable", or "I work for so and so and you don't want me to tell them you provide lousy service, do you?", so on and so forth (well she looks cute too, and I am sure it helps). Women seem to be more "convincing" that way, and I mean this with all due respect and awareness of inter-gender communication evolution.
Good luck, and don't get discouraged, try different people, different times, and different avenues and you'll get what you want (or go to the CDCA).

Any advice on arbitration?
Assuming you just purchased the FJ and they installed the wheels themselves without any recommendation/requests from you....
I, being someone with little time to deal with annoying little things like this I would just walk up to the sales manager or owner and demand they remove the wheels and refund your money. Either they do it you you file a law suit and then it will cost them a lot more to defend the case then just do the right thing in the first place.
The heck with letters or formal processes with goons like this...who has time for that? Just hit them between the eyes and let them pick up the pieces.
They should also have given you the stock wheels when you first purchased the FJ. After all...you did pay for them as part of the price of the vehicle. If they didnt...demand those too.
