I imediatly said;
What does the Owners Manual tell you to do? What does it say?
If you are doing ANYTHING, other, than what the owners manual says to
do regarding parking you are NEGLEGENT.
Sorry, that's not the standard for negligence. As it seems that most reasonable people DO NOT in fact engage the parking brake when parking manual transmission vehicles, there would be nothing negligent about not engaging it here. Nice try but it's a legal term of art not to be thrown around loosely.

so we are to assume that if you are a reasonable person, then you are allowed not to use proper parking technique stated in the manual?
let me interject something here
OK, many do not set the brake, that is common, I agree, weither it is correct or not is not the issue here. Many feel that engine compression should hold the vehicle.
first, since the modle T, I am not aware of a vehicle that has POSITIVE compression. That is why we have VALVE OVERLAP. you see, never does both intake and exhaust valve(S) close at the same time. So therefore we rely on engine friction to keep it from turning and the vehicle from rolling.
BUT, nowdays we are using more and more alloys in egines to make moving surfaces, and the surfaces the move against less prone to wear, in other words slipperier (is that even a word?) Anywa so the habits we used 10 years ago may not be as safe today as they were then.
Chaulk it up to modern technology, and desiners wanting to make vehicles last longer and get better fuel mileage, while still delivering more and more Horse POwer.
So you see. Maybe the phenom of the thing rolling easier than your 85 Hilux pickup is due to advances in design, and maybe the habit of not pulling the parking brake is something we should rethink.
so we are to assume that if you are a reasonable person, then you are allowed not to use proper parking technique stated in the manual?
Pretty much -- you will be held to the standard of what a reasonable person does -- if a reasonable person does not use the parking brake (and I think there's a good argument that many, if not most, people driving manual transmission vehicles do not) then you will not be negligent in not using the parking brake.
Incidentally, tried parking on a hill today without the brake -- mine doesn't roll.

so, if there were 1000 people doing Smack, and you were the 1001st, it would be ok to do heroin with them
in a society of 1001, 1000 would be reasonable

If you are doing ANYTHING, other, than what the owners manual says to
do regarding parking you are NEGLEGENT. Now that is not an attack, just
a word, but in a court of law it is an EXTREMALY POWERFUL word.
So, with that being said, can smeone w/ a manual FJ please post up
the verbatum on what the owners manual instructs on HOW TO PARK.
Dollars to doughnuts it says SET THE HANDBRAKE / PARKING BRAKE or something really close to that. I can't believe a dealer would even entertain for a moment this issue w/o first consulting the owners manual.
SO, I could be wrong, WHAT DOES IT SAYS GENTS WHOM OWN MANUALS?
If it says chock the wheel sand you d not chock the wheels its your problem. FOR the heck of it, what is the standard procedure to park a semi?
Betcha the owners manual says CHOCK THE WHEELS! LOL
Okay, page 134 of the manual (I am pretty sure it is the same manual that comes with the automatic) says verbatim: "When parking, firmly apply the parking brake to avoid inadvertant creeping." Followed by the instructions on how to set and release.

Have you ever heard of a method of hair removal called
WAXING? I betcha if you tried REAL hard, you could yank
that poor excuse for a stash off in one heartbeat w/ small
can of Henrys roof mastic and some 80grit.
What did you say? yep, this is where its at today...
Hello my friend...............

Ah HA! So a REASONABLE MAN, whom knows the laws will do the above,
religiously, or suffer the consequences. I PRAY, it is not the death of a
child or anyone for that matter.
